The Uzbek Patent and Trademark Office conducts correspondence in Uzbek and Russian language. Any foreign applicant needs to appoint a local Patent Attorney for handling its IP matters before the Office, with some provisions: for example, Russian applicants can be represented by a Russian trademark attorney. The appointment should be confirmed with a signed Power of Attorney. In most cases, the original document is required, while sometimes a copy of the Power of Attorney may suffice.
Average examination timeframe by the Uzbek Patent and Trademark Office is up to 1 year for utility models and industrial designs, in general more than a year for inventions, and 10 to 12 months for trademarks. An accelerated examination procedure is available for trademark applications. Trademark prosecution involves possibility of filing oppositions by third parties.
When an IP-related matter proceeds to court, they are considered by an administrative, economic or criminal court, depending on the case. An attorney well-versed in the local court practice will ensure protection of the client’s best interest in any matter.
