Mongolia is a country in East Asia, located between Russia and China. Being one of the global growth generating countries, Mongolia presents a market open to development and innovation. Official implementation of electronic transactions facilitates obtaining protection and defending intellectual property rights. The national currency of Mongolia is tögrög, also known as tugrik.
The Mongolian Patent and Trademark Office conducts correspondence in Mongolian language. Documents in English may also be accepted by the Office, but will require a translation into Mongolian within 2 months from the date of filing. Any foreign applicant needs to appoint a local Patent Attorney for handling its IP matters before the Office. The appointment can be confirmed with a copy of signed Power of Attorney, the original Power of Attorney will not be necessary for the proceedings.
Average examination timeframe by the Mongolian Patent and Trademark Office is about 2 months for inventions, about 1 to 4 months for utility models, about 6 to 9 months for trademarks, and about 12 months for industrial designs. Trademark prosecution involves publishing the trademark for oppositions by third parties.
When an IP-related matter proceeds to court, they are considered by an administrative court. An attorney well-versed in the local court practice will ensure protection of the client’s best interest in any matter.
